Who Gets the Crop?

The lessee under a three year lease of a property near Boggabilla planted a crop in late October shortly before the date of expiration of the lease term on 10 November 1999. The provisions of the lease contained all the normal lessee covenants such as those relating to the continuous eradication and keeping down of noxious weeds and other growths and the use of approved methods of farming. The lease also contained another clause resulting in a dispute between the parties as to who should get the benefit of the crop.
